The Migrant Workers Office (MWO) serves as the Department of Migrant Worker (DMW) as the operating arm in the implementation of the Philippine labor policies & programs for the protection of the rights & promotion of welfare & interests of Filipinos working abroad.

FUNCTIONS AND RESPONSIBILITIES

  1. Verification of Employment Documents
  1. Ensure that all the employment rights, benefits and welfare of Filipino migrant workers at the worksite are duly protected.
  2. Ensure that the employment contracts of the Filipino migrant workers are consistent with the prevailing employment laws, standards, and practices in both the Philippines and the host country and that the documentary requirements for overseas employment as required by the DMW are complied with.
  3. Conduct on-site verification, if necessary, to establish the existence of the employer/principal and its ability to hire workers based on the standards prescribed by the DMW and with the labor laws and regulations in the country of employment.
  1. Accreditation of Foreign Placement Agency (FPA) and Employers
  1. Verify the existence and license validity of the FPA, Philippine Recruitment Agency (PRA) and Employers/Company.
  2. Ensure that both FPA and the Employers assume joint and solidary liability with the PRA for all claims and liabilities which may arise in connection with the employment of workers.
  1. OFW Pass / Issuance of Overseas Employment Certificate (OEC)
  • Under the law, all departing OFWs, whether new hires or Balik Manggagawa are required to secure an OFW Pass / Overseas Employment Certificate (OEC) which shall serve as exit clearance and as exemption from payment of travel tax and airport terminal fee.
  1. Renewal of OWWA Membership
  • In line with OWWA’s mandatory requirement to promote the welfare of OFWs, workers may register/renew under the on-site membership program with MWO

 2.  Case Handling and Management 

  • For work-related complaints, the procedure starts upon receipt of complaints and ends upon settlement/resolution of the case at the level of the MWO or upon referral of the case to the competent authority.

SERVICES AND ASSISTANCE

        The MWO shall handle complaints and dispute cases which are inherently labor in character or arising out of employer-employee relations, such as those involving salaries and wages, violation of other terms and conditions of employment contracts, termination, and others.

       Assistance may also be rendered in cases of medical problems, non-performance of family obligations, ascertaining whereabouts, runaways, and other similar grievances.

The Assistance to Nationals Section (MWO-ATN) within the MWO is tasked with addressing incidents such as sexual offenses, physical injuries/abuses, and other criminal violations against workers, with the aim of safeguarding workers' rights more comprehensively.

BASIC ASSISTANCE AND SERVICES

  1. Counselling.  Right information and proper guidance shall be dispensed through counselling by the MWO at the initial contact with the worker, particularly in handling grievances from work and/or cultural adjustments;
  2. Conciliation/Legal Advice.  The MWO shall exhaust all available remedies to amicably settle all disputes and shall invite parties to conciliation meetings/In the event that conciliation may no longer be possible and the workers’ complaint requires submission to the labor arbitration process in the host country, the MWO shall assist the workers in all stages of proceedings and provide legal advice as may be feasible;
  3. Medical and Hospital Assistance, Representation and Onsite Visitations.  The MWO shall provide medical/hospital referral and assistance to workers who are physically, mentally and/or emotionally likewise, representations with local authorities and visits at the workplace, campsites, hospitals and prisons, whenever possible, shall be undertaken;
  4. Provision of Temporary Shelter to Workers in Distress.  In countries where there is Migrant Workers and Other Filipino Resource Center (MWOFRC), a temporary shelter shall be provided by MWO to female workers in distress subject to certain admission rules and criteria;
  5. Skills Training, Capacity-Building and reintegration Services.  The MWO and OWWA, through its Welfare Officers in the post, shall conduct a continuing program toward OFW skills training and upgrading, capacity-building seminars, and reintegration preparedness program for OFWs;
  6. Special Operations.  The MWO, in coordination with the Head of Mission, shall undertake relief and rescue operations to assist Filipino workers in distress and during for this purpose, the MWO shall endeavour to establish contacts and liaison with local authorities and support groups for information gathering and cooperative relationships.

 

VERIFICATION OF EMPLOYMENT DOCUMENT

Verification, as one of the primary functions of the Migrant Workers Office (MWO), refers to the procedure being conducted or applied by the Labor Attaché to ensure that all the employment rights, benefits, and welfare of the Filipino migrant workers at the worksite are duly protected.  The Labor Attaché shall also ensure that the employment contracts of the Filipino migrant workers are consistent with the prevailing employment laws, standards, and practices in both the Philippines and the host country and that the documentary requirements for overseas employment as required by the Department of Migrant Workers (DMW) are complied with.

Duly accomplished Standard Employment Contract, signed by Employer, Foreign Recruitment agency representative, and must be notarized by any Malaysian Notary Public.  Worker and the Philippine Recruitment Agency representative will sign upon receipt of the contract in the Philippines.
